1. Introduction

These Terms of Service govern access to and use of the Hearthbound website, forums, in-game server, and related community platforms.

Hearthbound is a text-based roleplay project built around the game Hytale. The website and forums exist to support and facilitate the Hearthbound in-game server, which is owned, operated, hosted, and funded by Qualworks Ltd.

By accessing or using the Hearthbound website, forums, in-game server, or services, you agree to be bound by these Terms of Service.

3. Accounts, Registration, and Age Requirement

To post or submit content on the Hearthbound forums or access in-game services, users must register an account.

You must be at least 13 years of age to create an account or use Hearthbound services. By using Hearthbound, you confirm that you meet this age requirement.

You are responsible for:

  • Maintaining the confidentiality and security of your account
  • All activity conducted under your account

We reserve the right to suspend or terminate accounts at our discretion, including for breaches of these Terms or applicable community rules.

4. Community Rules and Conduct

Use of the Hearthbound website, forums, and in-game services is subject to our published community rules. These rules govern behaviour on the forums, in-game roleplay, and related community spaces.

Moderation decisions made by the Hearthbound team are final.

5. User-Generated Content

Users may submit or create content on Hearthbound, including but not limited to lore, character backstories, stories, artwork, and in-game builds or structures created on the Hearthbound server.

You confirm that any content you submit or create is your own work, or that you have the necessary rights and permissions.

6. Licence to Use Submitted and Created Content

By submitting content to Hearthbound, or by creating content on the Hearthbound in-game server, you grant Qualworks Ltd an exclusive, perpetual, irrevocable, worldwide, royalty-free licence to use, reproduce, modify, adapt, integrate, publish, distribute, and commercialise that content as part of the Hearthbound project.

You retain ownership of your original work. However, you may not reuse, republish, or distribute submitted or created content in any manner that reproduces, conflicts with, or suggests official association with Hearthbound, without prior written permission from Qualworks Ltd.

7. Hearthbound Intellectual Property

All original content created by the Hearthbound team, including the branding, overarching lore, factions, and server configurations, is the intellectual property of Qualworks Ltd.

9. Payments and Purchases

Certain features may require payment. Prices are set by Qualworks Ltd and include VAT where applicable.

11. Refund Policy

All purchases made through Hearthbound are final and non-refundable, except where required by law.

By completing a purchase, you expressly waive any statutory right to cancel once delivery of digital content or services has begun.

14. Termination Effects

If your account is suspended or terminated, you immediately lose access to the website, forums, and in-game server. Any paid content tied to your account is forfeited without refund.

16. Chargebacks and Payment Disputes

Initiating a chargeback without first contacting us may result in immediate termination of the associated account. We reserve the right to contest chargebacks.

20. Disclaimer and Limitation of Liability

We make no guarantees regarding uptime or preservation of user content. Use of the site and services is at your own risk.

23. Governing Law

These Terms of Service are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
